Determine whether is a valid cause of action; Determine if, in fact the injured party has any claim at all.  If there is no underlying claim or no sustainable theory of recovery there is no remedy available.

Analyze the full range of remedies which may be available. Narrow the choice to one or more which may be applicable to the facts:

  •  Remedy at law damages

    1.    nominal

    2.    compensatory

    3.    punitive

     

  • Equitable remedies

    1.  specific performance

    2.  injunction

    3.  constructive trust

    4.  bills of peace

    5.  interpleader

    6.  quia time

    7.  actions to remove clouds on title and to quiet title

     

  •     Where there is a contract

    1.  recission

    2.  restitution

    3.  reformation

Analyze possible defenses:

  • Equitable defenses

  •  laches

  •  clean hands doctrine

  •  fraud or misrepresentation

  •  contract is unconscionable

  •   Defenses to action at law (among others)

    •  statute of limitation

    •  illegality
