About 200 high school kids attended a party where they paid admission to drink unlimited beer. Sean attended the party with several friends, including David. At one point Sean and his friends were approached by a group of about 20 boys who accused Sean's group of making derogatory comments. Sean and his friends denied making the comment, said they did not want trouble and left the party. As they left the party, Sean and David was approached by Val who demanded that Sean give him a beer. When Sean refused Val took a swing at Sean with a wine bottle. Sean ducked and the wine bottle hit David instead. David suffered a permanent condition called "mucosal mouth and permanent partial numbness in one lip as a result of the blow.  Val was charged with aggravated battery based on permanent disability and great bodily harm.
