Raymond Garnett is a 20 year old, mentally disabled man. He has an IQ of 52 and interacts socially at the level of an 11- or 12-year old. In November or December 1990, a friend introduced Garnett to Erica Frazier, a 15 year old girl. Raymond mistakenly believed that Erica was 16. On February 28, 1991, Erica invited Rayon into her bedroom and the two had sexual intercourse. Nine months later, Erica gave birth to a child. Raymond is the biological father. At the insistence of Erica’s parents, Raymond was arrested of second degree rape under Maryland Code § 463. The code provided that “A person is guilty of rape in the second degree if the person engages in vaginal, anal or oral intercourse with another person who is under 16 and the person performing the act is at least four years older than the victim.” What out come?
