During most classes we will work on problems, in fact the primary focus of the class will be on problems. You should work out an individual answer to the assigned problem, think about the unassigned problems and be prepared to fully participate in the class on all the readings.  You are NOT prepared for class unless you have three copies of your assignment with you.
 
Minimum Required Answer:
  • What ethical rules (Ohio State or ABA), if any govern, the situation in the problem?
  • What conduct described in the problem either does or might violate a formal ethical rule?  What conduct appears to violate some other obligation of a lawyer? What obligation? Does the responsibility under Ohio State Rules differ from the ABA Rules?
  • How do you feel a lawyer should be acting in these circumstances and why? Is there a tension or conflict between what you feel a lawyer should do in this situation and what the black letter rules seems to say a lawyer must do?
 
Thought Questions:

Thinking about the following questions will help you be prepared for class:

  • What ethical rules, if any govern, the situation in the problem?
  • What conduct described in the problem either does or might violate a formal ethical rule?
  • What conduct appears to violate some other obligation of a lawyer?
  • Might the conduct result in civil liability for the lawyer or law firm?
  • Is there tension or conflict between competing interests or rules of conduct, and if so, in  what respect and why?
  • How do you feel a lawyer should be acting in these circumstances and why?
  • Is there a tension or conflict between what you feel a lawyer should do in this situation and what the black letter rules seems to say a lawyer must do?
  • What practical considerations may be difficult to ignore in determining how a lawyer may behave in these circumstances.
  • What other, if any,  issues or points  you think is important to consider when addressing this problem?

 

 

Formatting Convention:  (Problem Template)

  • typed, single spaced, 12 pt. Times Roman, margins 1 inch.
  • Use the following headings
    • Ethical Rules Governing the Situation
    • Analysis of Lawyer's Conduct
    • How Should Lawyer Behave in Circumstances
  • No More than one page.
  • Save the file using the following:

    Last Name First Name Initial Middle Initial Problem Number
    Example:   RandallVRProblem01.doc

YOU SHOULD BRING THREE COPIES of YOUR PROBLEM ANSWER to CLASS. Two copies will be turned in during class. Fold one of the problem vertically in half and put your name in bottom right corner, put the problem number on the second line. The second problem should be folded as well, DO NOT PUT your name on the second problem. Instead, put your problem number.

Problem answers  will be collected during class. No problems answer will be accepted late (That is after class); No exceptions!

  Your problem answer should reflect a good faith attempt to answer the question.  No credit will be given  if you are not in class. That is, you cannot turn in problems if you are absent from class..

 
 Evaluating Your Problem for Class Participation

For each problem you should prepare your own answers BEFORE CLASS. Those answers should be turned in at every class.  To be prepared for class, your problem answer should reflect a good faith attempt to answer the question.    Good Faith Effort will be judged by whether your answer made significant attempt to address the problem in accordance with the guidelines.
