Lesson Outline

 

  1. Equitable maxims are both substantive and procedural; Courts use the maxims in one or two ways: enabling or restrictive.
  2. Enabling pertain to the subject of equitable jurisdiction and the granting of relief
    1. Restrictive causes the court to deny relief
    2. While courts do refer to specific maxims as often as courts in the past., but the equitable maximums help in analysis of issues and in predicting the outcome of a case.
  3. Common Equitable Maxims
    1. He who seeks equity must do equity.
    2. Equity will not enforce an unconscionable contract.
    3. He who comes into equity must come with clean hands.
    4. Equity is not an avenger at large.
    5. Equity aids the vigilant, not those who slumber on their rights.
    6. Equity acts in personam.
    7. Equity follows the law.
    8. Equity delights to justice and not by halves.
    9. Equity will not suffer a wrong to be without a remedy.
    10. Equity regards that done which ought to be done.
    11. Equity regards substance rather than form.
    12. Equity imputes an intent to fulfill an obligation.
    13. Equality is equity.
    14. Between equal equities the law will prevail.
    15. Between equal equities the first in order of time will prevail.
    16. Equity abhors a forfeiture.
    17. Equity will not aid a volunteer
